We draw on a wide range of experiences in our representation of trustees, creditors and debtors. We have in-depth knowledge and experience recognizing valuable assets and providing the means by which to maximize value for the bankruptcy estate, and we regularly monitor and oversee distributions to creditors. Our services include restructuring loan transactions, as well as assisting our clients to purchase or sell ownership interests or assets of distressed companies. We also provide our clients with advice on proper corporate structures (including special purpose entities) and assistance with debtor/creditor workouts. Litigation and Disputes Our legal practice includes the representation of clients in cases dealing with preferences, fraudulent transfers, lien avoidance, secured creditor rights, forfeiture, setoff, lender liability, breach of contract, discharges and numerous other creditors’ rights issues. We also work with other practice groups in the Firm to provide valuable assistance regarding transactional matters which might result in bankruptcy, insolvency or collection issues if not adequately addressed. Representation of Financial Institutions We regularly represent financial institutions in bankruptcy and creditors’ rights issues, and we are often involved in pre-bankruptcy planning issues. Furthermore, we have in-depth experience representing debtors, bankruptcy trustees and examiners in Chapter 11 cases. Preventive Work The costs of a corporate bankruptcy can be tremendous. It often is much more cost effective for the client, its investors and its creditors to prevent the bankruptcy if at all possible. We work proactively with our clients to identify potential bankruptcy issues and resolve such issues, thereby minimizing the risk that our clients will undergo bankruptcy proceedings.
