Antitrust Litigation
Our antitrust team draws on the firm’s strength in both white collar criminal defense and in complex civil litigation. Attorneys in the firm have tried both criminal and civil antitrust cases to verdict and have handled government investigations and grand jury proceedings for both the prosecution and defense. Our antitrust team also has substantial experience in performing internal investigations and in representing officers and directors and can rapidly respond in situations in which a corporation must decide whether to avail itself of the corporate leniency and civil damage suit opportunities provided by the Antitrust Criminal Penalty Enhancement and Reform Act of 2004 (“ACPERA”). Our antitrust lawyers have represented clients in civil antitrust cases in industries as diverse as health care, food products, motion picture distribution, and telecommunications. In addition, our attorneys in this practice area work with other attorneys in the firm to counsel clients on antitrust issues that may arise in connection with joint ventures, exclusivity and resale price maintenance arrangements, standard-setting in professional and trade associations, regulation of single firm conduct, and mergers.
Commercial Litigation
Allegations of fraud and breach of fiduciary duty, disputes among lenders with competing interests, employers and employees with covenants not to compete and nondisclosure agreements, breach of contract claims, declaratory judgments sought over the meaning of insurance agreements and indemnity clauses, premises liability issues, lender liability allegations, partnership disputes…none of these is new to CTT’s commercial litigators, who have years of experience in handling these and other types of business disputes. Should the client’s problem call for immediate injunctive relief in the form of temporary restraining order followed by expedited discovery and a preliminary injunction hearing, for arbitration or mediation, or for trial, our lawyers’ combination of negotiation and trial skills, our experience in many industries, and our ability to draw on the substantive expertise of attorneys in other transactional specialties in the firm provide our clients with a resourceful and energetic ally in the resolution of their commercial disputes.
Products Liability Litigation
Our litigators individually and collectively have many years of experience in handling products liability cases throughout Texas (including along the Gulf Coast and in the Rio Grande Valley) as well as in other states including Oklahoma, Louisiana, Mississippi, Alabama, Kentucky, and West Virginia. Before joining CTT, Chris Harvey was the head of the products liability division at another Dallas firm for a number of years. He has tried products liability cases involving a variety of products and has been regional and lead trial counsel in a number of automobile crashworthiness cases involving catastrophic injuries. Rob Roby’s experience in products liability cases has included defending cases involving allegedly defective cranes, lifts, elevators/escalators, punch presses, firearms, aircraft engines and components, electrical devices, switches, and power tools. Lea Courington has defended cases in which it is alleged that tobacco products, constituents in welding fumes, manufacturing equipment, appliances, prescription and over-the-counter medications, and blood transfusions have caused personal injuries.
Securities Litigation
CTT attorneys have handled a wide variety of regulatory, administrative, and federal and state actions involving the securities industry. We are experienced in defending clients in administrative proceedings and civil lawsuits brought by the Securities and Exchange Commission and state securities boards, as well as in proceedings brought before FINRA and other regulatory bodies. Further, we understand how to manage disputes that involve both government enforcement and parallel lawsuits brought by private parties. Our litigation team is experienced in executing coordinated strategies to ensure that all current and potential legal proceedings are considered when responding to disputes relating to the securities industry.
Toxic Torts and Other Environmental Litigation
We represent clients in all types of toxic tort and environmental litigation. Our environmental litigation capabilities include representation in federal and state courts in environmental enforcement actions brought by federal, state, and local regulatory agencies and by various groups under the major environmental statutes. This work includes multi-media enforcement cases, Natural Resource Damage actions, citizen suits, and toxic tort litigation, including class action litigation and litigation involving large numbers of plaintiffs in which no classes have been certified. We also litigate environmental issues, land use disputes and environmental insurance coverage claims. Our experience in these areas and the experience of our firm’s environmental section helps us advise clients on compliance and other measures that aid the clients in avoiding litigation.
Intellectual Property Litigation
Our litigators are experienced in the handling of trademark and unfair competition cases in federal and state court and have acted as local counsel/co-counsel for national firms in patent, trademark, and copyright cases in federal courts in Texas.
White Collar Defense
Clients facing today’s high stakes prosecutions require an experienced and focused defense team. CTT’s white collar crime and complex civil litigation group has a wealth of experience and insight, both in and out of courtrooms in representing corporations and their key decision makers. The group frequently represents clients in federal and state white collar prosecutions and in a full range of federal and state investigations as well as in companion civil litigation, including securities fraud, antitrust, qui tam, environmental, and health care cases.
Professional Liability Litigation
CTT’s attorneys are often called upon to represent physicians, accountants, architects, engineers and lawyers facing professional malpractice claims which have the potential to jeopardize our clients’ reputations and professional livelihood. Our services in this area include not only the defense of professional liability claims, but also advice on disciplinary and licensure matters.
Appellate
CTT’s attorneys who have handled cases at the trial court level frequently handle the appeals in those cases as well. In addition, our attorneys have been retained to pursue petitions for writs of mandamus and other relief in the state and federal courts.
